1. Acceptance of Terms
Welcome to Ubuntu BizFind, a directory of South African businesses brought to you by Imbizo Technologies, located at 12 Van Riebeeck Street, Cape Town, 8001, South Africa. By accessing and using Ubuntu BizFind (the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the Service. These terms apply to all users, including browsers, vendors, customers, merchants, and contributors of content.
2. Description of Service
Ubuntu BizFind is an online business directory that allows users to search for and locate businesses operating in South Africa. The service provides business listings, contact information, and other relevant details. Imbizo Technologies reserves the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.
3. User Conduct
You agree to use the Service only for lawful purposes and in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of the Service. Prohibited behavior includes harassing or causing distress or inconvenience to any other user, transmitting obscene or offensive content, or disrupting the normal flow of dialogue within the Service. You specifically agree not to:
- Post, upload, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
- Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
- Forge headers or otherwise manipulate identifiers in order to disguise the origin of any content transmitted through the Service.

- Upload, post, email, transmit or otherwise make available any content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party.
- Upload, post, email, transmit or otherwise make available any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation.
- Upload, post, email, transmit or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.
- Interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service.
- Intentionally or unintentionally violate any applicable local, state, national or international law.
- "Stalk" or otherwise harass another.
- Collect or store personal data about other users.
4. Intellectual Property
All content included as part of the Service, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the Service, is the property of Imbizo Technologies or its suppliers and protected by copyright and other laws that protect intellectual property and proprietary rights. You agree to observe and abide by all copyright and other proprietary notices, legends or other restrictions contained in any such content and will not make any changes thereto.
You will not modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part, found on the Service. Imbizo Technologies content is not for resale. Your use of the Service does not entitle you to make any unauthorized use of any protected content, and in particular you will not delete or alter any proprietary rights or attribution notices in any content. You will use protected content solely for your personal use, and will make no other use of the content without the express written permission of Imbizo Technologies and the copyright owner.
5. Business Listings and Accuracy
While Imbizo Technologies strives to ensure the accuracy of the information provided on Ubuntu BizFind, we do not guarantee the accuracy, completeness, or timeliness of business listings. Business owners are responsible for ensuring their listings are accurate and up-to-date. Imbizo Technologies is not responsible for any errors or omissions in business listings or any damages arising from reliance on such information. 6. Limitation of Liability
In no event shall Imbizo Technologies, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
The maximum liability of Imbizo Technologies to you for any claim arising out of or relating to these Terms or the Service is the amount you paid to Imbizo Technologies for the Service in the 12 months preceding the claim. This limitation applies regardless of the legal theory on which the claim is based.
7. Indemnification
You agree to indemnify and hold Imbizo Technologies and its affiliates, directors, officers, employees, and agents harmless from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your use of the Service, your violation of these Terms, or your violation of any rights of another.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Cape Town, South Africa to resolve any dispute arising out of or relating to these Terms or the Service.
9. Changes to Terms
Imbizo Technologies reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use the Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
